The short answer is, “Yes” the Delta-8 found in Vybba is completely legal under federal law. More specifically, Delta-8, and all cannabinoids actually, are covered by a well-known piece of legislation, which we will get to in a moment.
Because our Delta-8 is derived only from hemp, it has a very specific status, one that makes it legal for adults to order across the United States. (Other countries may have different, more restrictive laws, so the legal status in a different country may have a different classification). For now, let’s stick to the United States laws that regulate our Vybba Delta-8.
On December 20th, 2018 the Agriculture Improvement Act of 2018 (also known as The 2018 Farm Bill) was signed into law.
This gigantic, 530-page bill set aside over $867 billion in tax dollars for everything from crop insurance for farmers to healthy food access for low-income families. The Farm Bill has been passed many times by bipartisan efforts, 2018 is only the most recent version, but the one that specifically discusses our Delta-8.
Near the end, (on page 420 actually) the Farm Bill differentiates between hemp (a commercial crop) and marijuana (an illegal drug)...
HEMP — The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
Vybba is made from cannabinoids from a hemp plant with less than 0.3 percent Delta-9 THC. Under that definition it is legal to produce and sell Vybba in the USA. This hemp status has been tested and verified by independent third-party testing laboratories to be 100% compliant with the legal definition of a hemp-derived product.Every Vybba strip is tested and certified to comply with this legal requirement.

While we have established the federal legal status of hemp-derived Vybba, individual states can, and sometimes still do, have different rules in addition to the nation’s federal law.
